Court Sanctions Samsung In Mosaid Patent Suit

Law360, New York (July 9, 2004, 12:00 AM EDT) -- A judge has imposed sanctions against Samsung in chip maker Mosaid Technologies’ patent lawsuit against the South Korean electronics maker, chiding Samsung for destroying and failing to produce evidence during discovery.

New Jersey District Court Judge Ronald Hedges ordered that any trial jury be instructed to draw "adverse inference" from Samsung's destruction and non-production of e-mail. The ruling also stated that Mosaid can prove infringement of all Samsung parts if it proves infringement of representative parts, according to Mosaid.
