Judge Rejects Dismissal, Injunction In Aldara IP Spat

Law360, New York (June 11, 2010, 6:01 PM EDT) -- A federal judge has denied a motion by generics maker Nycomed U.S. Inc. to dismiss a suit brought by Graceway Pharmaceuticals LLC alleging infringement of a patent for skin lesion treatment Aldara, as well as rejecting the plaintiff's motion for a preliminary injunction.

Judge William J. Martini of the U.S. District Court for the District of New Jersey on Thursday rejected Nycomed's argument that the suit should be dismissed because Graceway failed to perform a prefiling investigation to determine if the defendant's generic infringed the patent-in-suit....
