High Court To Hear CSX Challenge To Ala. Taxes

Law360, New York (June 14, 2010, 12:25 PM EDT) -- The nation's highest court agreed Monday to take up the question of whether millions of dollars in diesel fuel taxes applied to railroad transport petitioner CSX Transportation Inc., but not its water- and highway-based freight hauling competitors, may be challenged as discriminatory.

The grant of certiorari was limited to the question of whether a state's exemptions of rail carrier competitors, but not rail carriers, from certain taxes on fuel subject the taxes to challenge under a federal law prohibiting tax discrimination, according to the court's order...
