Smarties Maker Sues Amazon Over Nestle Imports

Law360, New York (June 14, 2010, 4:06 PM EDT) -- The maker of the popular candy brand Smarties has sued Inc. for importing a chocolate candy made by Nestle SA that is sold under the same name in other parts of the world.

New Jersey-based Ce De Candy Inc. filed the trademark infringement suit June 3 in the U.S. District Court for the District of New Jersey.

The plaintiff has sold candy wafers, distributed in slim plastic rolls, under the moniker Smarties since 1949, according to the complaint. It produces billions of the popular candy...
