Circuit Court Defeats Unions’ Pension Petition

Law360 (January 30, 2007, 12:00 AM EST) -- The U.S. Court of Appeals for the First Circuit has upheld a ruling handed down by the National Labor Relations Board, dismissing union complaints that a government warship building company violated fair labor standards by unilaterally merging pension plans.

The circuit court on Monday there to be “a sound, arguable basis” for Bath Iron Works Corp. deciding to merge its employees’ pension plan with that of its parent company without the unions’ consent.
