Law360 (June 18, 2010, 5:23 PM EDT) -- A proposed class of Virginia landowners has sued Consol Energy Inc., arguing that coal mining leases held by the company do not give it the right to capture and sell coalbed methane found in the land.
The putative class, which includes more than 100 landowners in Tazewell, Buchanan and Russell counties in Virginia, lodged a 22-page complaint Tuesday in the U.S. District Court for the Western District of Virginia seeking damages, royalties and a declaration that its members are rightful owners of the CBM resources.
