9th Circ. Won't Touch San Diego Seal Spat

Law360, New York (June 16, 2010, 3:29 PM EDT) -- A federal appeals court has refused a wildlife group's bid for an emergency injunction to require San Diego to put up a rope at a local beach to protect a group of seals, saying it does not have jurisdiction over the matter.

The U.S. Court of Appeals for the Ninth Circuit said Tuesday that La Jolla Friends of the Seals was seeking a writ of mandate under state law and that the court has “no jurisdiction to entertain such a request.”
