USPTO To Reexamine E-Learning Patent

Law360, New York (January 30, 2007, 12:00 AM EST) -- A dispute between two educational software makers got a second wind on Thursday, with the U.S. Patent and Trademark Office agreeing to take a second look at a patent covering e-learning tools in response to a challenge from a software group.

The Patent Office said in its reexamination order, issued on Jan. 25, that a “substantial new question of patentability” regarding all 44 claims of a patent held by educational software maker Blackboard Inc. was raised by Software Freedom Law Center’s request for ex parte examination,...
