Judge Deals Blow To Acacia In Controversial Patent Suit

Law360, New York (July 14, 2004, 12:00 AM EDT) -- A federal judge has dealt a setback to Acacia in its closely watched patent-infringement lawsuit against adult websites over key patents for on-demand entertainment.

In a preliminary Markman ruling issued this week, U.S. District Judge James Ware ruled that several key terms in the controversial patents were indefinite, potentially eliminating most of the claims Acacia brought against the adult sites.

The decision could affect Acacia’s lawsuits against nine major cable and satellite providers, filed last month.
