High Court Won't Hear Procrit Whistleblower Suit

Law360, New York (June 21, 2010, 11:38 AM EDT) -- The U.S. Supreme Court on Monday declined to hear a case against Ortho Biotech Products LP that raised the question of whether a whistleblower could bring kickback claims against the company if the alleged scheme was already revealed in a multidistrict litigation.

The court's order came after the solicitor general's office in May recommended the high court deny certiorari, saying the ambiguity surrounding who is an original source under the False Claims Act was resolved with the passage of President Barack Obama's health care act....
