Caterpillar Retirees' ERISA Claims Too Late: 6th Circ.

Law360, New York (June 22, 2010, 6:57 PM EDT) -- The benefits claims of 275 workers who retired from a Caterpillar Inc. subsidiary during the 1990s were time-barred, a federal appeals court ruled Tuesday, reversing an injunction that forced the machinery company to pay them lifetime health care costs.

The U.S. Court of Appeals for the Sixth Circuit agreed with Caterpillar that the subclass' Employee Retirement Income Security Act claims, lodged in 2006, related to benefits changes that took place in 1998 and became effective in 2000, and therefore were barred by a six-year statute of...
