Fed. Circ. Backs Commerce On China Wax Candle Duty

Law360, New York (June 23, 2010, 5:15 PM EDT) -- A federal appeals court has affirmed a determination by the U.S. Department of Commerce that certain wax candles from China are later-developed merchandise and can be covered by an anti-dumping duty order that originally did not include them.

Commerce's interpretation of the relevant congressional statute was reasonable and is entitled to deference since it was based on substantial evidence, the U.S. Court of Appeals for the Federal Circuit said Monday.
