Section 510 Doesn't Cover Work Complaints: 3rd Circ.

Law360, New York (June 25, 2010, 5:53 PM EDT) -- A federal appeals court has upheld the dismissal of a suit accusing a construction company of violating the whistleblower protection provisions of the Employee Retirement Income Security Act, saying the statute does not protect against simple internal complaints.

In a 2-1 decision lodged Thursday, the U.S. Court of Appeals for the Third Circuit answered what it called a question of first instance in the circuit.
