11th Circ. Finds For Century In Enviro Coverage Feud

Law360, New York (June 28, 2010, 1:01 PM EDT) -- A federal appeals court has ruled that a pollution exclusion absolves Century Indemnity Co. of defending or indemnifying Florida's Duval County School Board for damages related to the $75 million settlement of a toxic tort.

The U.S. Court of Appeals for the Eleventh Circuit upheld a district court’s order granting summary judgment to the insurer Thursday, dismissing the school board’s arguments in a feud over coverage for an environmental class action related to the construction of a school on a contaminated site.
