Boeing Can Try Preemption Defense Again In Crash Suit

Law360, New York (June 29, 2010, 2:32 PM EDT) -- The Boeing Co. has won another chance to argue that the state law tort claims in a lawsuit seeking to hold the company liable for a Denver plane crash are preempted by federal aviation laws.

On Monday, Judge Robert E. Blackburn of the U.S. District Court for the District of Colorado certified for interlocutory appeal his order denying Boeing's motion to dismiss the lawsuit brought by passengers on Continental Airlines Flight 1404, which in December 2008 veered off the runway during takeoff at Denver International Airport....
