EU Court Backs De Beers' Vow Not To Buy From Alrosa

Law360, New York (June 29, 2010, 12:31 PM EDT) -- Following the recommendation of Advocate General Juliane Kokott, the European Union's highest court on Tuesday overturned a decision annulling a commitment by De Beers Consolidated Mines Ltd. to stop purchasing diamonds from Alrosa Co. Ltd.

The European Court of Justice said the Court of First Instance erred in its July 2007 ruling that the proportionality principle — a requirement that competition law remedies cannot exceed the scope of their underlying offenses — applies to cases where companies propose their own solutions.
