DC Circ. Nixes GE Challenge To EPA Cleanup Authority

Law360, New York (June 29, 2010, 2:19 PM EDT) -- A federal appeals court on Tuesday upheld a lower court's rejection of General Electric Co.'s due process challenge to the U.S. Environmental Protection Agency's authority to unilaterally order potentially responsible parties to clean up hazardous waste sites.

A three-judge panel of the U.S. Court of Appeals for the District of Columbia Circuit rejected GE's constitutional challenge to the EPA's unilateral administrative order authority under Superfund law.
