Evanston Sues To Duck Coverage In Drywall MDL

Law360, New York (June 30, 2010, 2:46 PM EDT) -- Evanston Insurance Co. has filed a declaratory judgment suit against real estate developers ensnared in the multidistrict litigation over defective Chinese drywall, claiming their policies do not cover damages related to the allegedly noxious and corrosive drywall.

The complaint, filed Tuesday in the U.S. District Court for the Eastern District of Virginia, argues that the three general commercial liability policies with Harbor Walk Development LLC plainly exclude coverage for the type of claims now facing the homebuilder and its contractors.
