2nd Circ. Revives Firefighter Hopefuls' Race Bias Suit

Law360, New York (July 1, 2010, 7:32 PM EDT) -- A federal appeals court has revived an employment discrimination case launched by two white would-be firefighters who claim an affirmative action program gave their jobs to less-qualified black applicants.

The district court should not have so easily concluded that a 30-year-old edict intended to swell a New York fire department's black ranks was still in force, the U.S. Court of Appeals for the Second Circuit ruled Thursday.
