Apple Seeks Review Of Kodak 'Button' Claim Ruling

Law360, New York (July 2, 2010, 2:54 PM EDT) -- Apple Inc. has urged the U.S. International Trade Commission to review an “overbroad” claim construction ruling that came down in Eastman Kodak Co.’s suit alleging smartphones made by Apple and Research In Motion Ltd. infringe its patent for digital camera technology.

The Cupertino, Calif.-based company on Wednesday filed a petition seeking the ITC to take a look at whether Chief Administrative Law Judge Paul Luckern erred in his construction of the patent claim term, “capture button,” following a Markman hearing.
