10th Circ. Upholds Target Win In Age Bias Suit

Law360, New York (July 2, 2010, 1:54 PM EDT) -- A federal appeals court has affirmed the dismissal of an age discrimination suit against Target Corp., agreeing with the district court that the employee's claims were fatally damaged by the revelation that her position was filled by an older employee.

A three-judge panel in the U.S. Court of Appeals for the Tenth Circuit ruled Thursday that Debra Martinez's appeals of four district court orders, including a summary judgment decision in favor of Target Corp., were in vain.
