Entergy, New Orleans Best $800M Rate Case

Law360, New York (July 13, 2010, 5:21 PM EDT) -- A Louisiana judge has refused to revive an $800 million class action challenging the way New Orleans set rates of return for utility Entergy Corp. for more than three decades.

Judge Herbert A. Cade of the Civil District Court for the Paris of Orleans dismissed an appeal from local residents claiming that the city council had improperly made changes to the rates of return that the utility is allowed to receive on its infrastructure investments through resolutions rather than through the more formal ordinance process....
