Insurer Fails To Kill Long-Dormant Arizona Premium Suit

Law360, New York (July 13, 2010, 6:37 PM EDT) -- A judge has declined to throw out Arizona Premium Finance Co. Inc.’s suit against Employers Insurance of Wausau over an alleged failure to refund unused insurance premiums for New York City livery service cars, despite years of inaction in the dispute.

Judge Sandra L. Townes issued an order in the U.S. District Court for the Eastern District of New York on Friday denying Wausau’s request that the case be dismissed on the grounds that the plaintiff failed to act for 50 months.
