Mass. AG Escapes Sanctions In Medicaid Fraud Suit

Law360, New York (July 14, 2010, 5:58 PM EDT) -- A federal judge has found that Massachusetts did not act in bad faith when it withheld documents that Warrick Pharmaceuticals Corp. claims support its position in a lawsuit over the drug prices charged to the state's Medicaid program.

Judge Patti B. Saris of the U.S. District Court for the District of Massachusetts said Monday that while it was overbroad, a discovery agreement between the parties allowed the state to withhold information from open investigations, which included an investigation into CVS/pharmacy.
