2nd Circ. Restores General Cigar Win In Cohiba Suit

Law360 (July 14, 2010, 7:07 PM EDT) -- A federal appeals court has reversed a Cuban cigar company's short-lived victory in a dispute over the use of the Cohiba mark in the U.S., restoring an earlier decision that gave control of the iconic brand to Richmond, Va.-based General Cigar Co.

A lower court that had reopened the case made too much of a state appellate ruling it thought changed the case law, the U.S. Court of Appeals for the Second Circuit said in a summary order issued Wednesday.
