Ex-Owners Not Eligible For Brownfield Grants: NJ Court

Law360, New York (July 16, 2010, 3:44 PM EDT) -- The New Jersey Supreme Court has ruled that a polluted property’s former owner, TAC Associates, is not eligible for a so-called innocent party grant to aid in cleanup efforts because it sold the site before applying for funds.

In a split decision, a majority in the New Jersey Supreme Court issued a decision Thursday reversing a ruling in TAC’s favor by a state appeals court and reinstating the New Jersey Department of Environmental Protection’s denial of the grant.
