New Jersey Sues EPA Over Clean Air Act

Law360, New York (February 7, 2007, 12:00 AM EST) -- New Jersey sued the Environmental Protection Agency on Tuesday after the federal bureau did not respond to complaints that air pollution from a power plant in Pennsylvania was drifting across the Delaware River and into the Garden State.

The lawsuit, filed in federal court in Trenton, claims that the EPA violated the Clean Air Act when it failed to respond to a petition against Portland Generating Station’s permit renewal application. PGS is a coal-fired power plant in Portland, Pa.
