Commerce Defends 14% Duty On Atar Pasta Imports

Law360, New York (July 20, 2010, 1:45 PM EDT) -- The U.S. Department of Commerce has told the Court of International Trade that a 14.45 percent dumping margin on pasta imported by Italy-based Atar S.r.l. was properly tallied, following an order by the court to justify the calculation.

The agency was within the bounds of the Tariff Act of 1930 when it assessed the rate, and has "ample discretion" in measuring profit when it determines dumping margins, Commerce said in a filing Monday in the CIT.
