NY Hospitals Lose Bid To Toss Nurses' Antitrust Claims

Law360, New York (July 22, 2010, 1:54 PM EDT) -- Two hospitals in upstate New York named in a class action over nurses' salaries will continue to face antitrust claims following a federal judge's ruling that a reasonable jury could conclude the defendants were engaged in collusive behavior.

Judge Thomas J. McAvoy of the U.S. District Court for the Northern District of New York rejected on Tuesday a joint summary judgment bid by Albany Medical Center and Ellis Hospital, finding that the plaintiffs had provided “sufficient evidence” of the existence of the alleged conspiracy.
