HP Inequitable Conduct Bid Fails In Blade Patent Fight

Law360, New York (July 23, 2010, 2:09 PM EDT) -- Patent-holding company Acquis LLC has succeeded in knocking out an inequitable conduct defense brought by Hewlett-Packard Co. and NEC Corp. in an infringement suit over blade server patents.

Judge Leonard Davis of the U.S. District Court for the Eastern District of Texas on Thursday granted Acquis' motion to strike the defendants' inequitable conduct affirmative defenses but granted HP and NEC leave to amend their pleadings.
