Food Co. Wants Insurer To Pay For Pom False Ad Suit

Law360, New York (July 26, 2010, 5:59 PM EDT) -- Fresherized Foods Inc. has sued Continental Casualty Co. in an effort to recover the cost of defending and settling a suit brought by rival Pom Wonderful LLC that accused Fresherized Foods of using its advertising idea to market pomegranate juice.

The complaint, filed Thursday in the U.S. District Court for the Northern District of California, seeks payment for defending and settling Pom's suit — or about $1 million — as well as prejudgment interest, costs and attorneys' fees.
