Humana Escapes Race Bias Class Action

Law360, New York (July 27, 2010, 11:32 AM EDT) -- A federal judge has dismissed a putative class action brought by a black former employee at health insurer Humana Inc., saying her discrimination claim cannot stand because it was not clear the white workers she compared herself to were doing the same job.

Judge Charles R. Simpson III of the U.S. District Court for the Western District of Kentucky issued the ruling Monday, throwing out both the class action and individual claims levied against the company by Kathryn Keys.
