7th Circ. Affirms Monsanto Win In Pension Class Action

Law360, New York (August 2, 2010, 1:48 PM EDT) -- A federal appeals court has thrown out a legal challenge to Monsanto Co.'s pension plan, agreeing with a lower court that a reorganization of the plan did not introduce age discrimination.

The U.S. Court of Appeals for the Seventh Circuit on Friday affirmed a summary judgment for Monsanto, saying that plan member Grant Walker's class action failed because, despite appearances, the plan rejigging did not actually decrease the benefits of plan members over 55.
