1st Circ. Orders Retrial In Unum False Claims Suit

Law360, New York (August 2, 2010, 7:00 PM EDT) -- A federal appeals court has ordered a new trial in a qui tam suit accusing Unum Group of violating the False Claims Act by requiring people to file for Social Security disability insurance regardless of their eligibility.

The U.S. Court of Appeals for the First Circuit on Thursday upheld a lower court ruling denying Unum's motion for judgment as a matter of law, but ordered a new trial after finding that the court improperly excluded evidence.
