5th Circ. Says Utex Can't Alter AT&T Contract

Law360, New York (August 3, 2010, 2:34 PM EDT) -- A federal appeals court has upheld the denial of bankrupt communications company Utex Communications Corp.'s bid to make changes to its contract with AT&T Texas as part of a regulatory proceeding before the Public Utility Commission of Texas.

The U.S. Court of Appeals for the Fifth Circuit on Monday upheld a district court's affirmation of the commission's order in favor of AT&T, finding the proposed contract changes were outside the scope of the proceedings.
