In Pari Delicto Claim Cut From Madoff Victims' Appeal

Law360, New York (August 3, 2010, 1:45 PM EDT) -- A bankruptcy judge has agreed to strike arguments concerning the doctrine of in pari delicto from an appeal filed by Bernard Madoff victims seeking to revive stayed suits against an alleged co-conspirator in the massive Ponzi scheme.

Judge Burton R. Lifland issued an order Tuesday in the U.S. Bankruptcy Court for the Southern District of New York agreeing to eliminate the arguments from the appeal and barring the use of associated documents.
