Chemtura's Challenge Of Cleanup Claims Goes On

Law360, New York (August 4, 2010, 7:03 PM EDT) -- Despite creditor protests, a bankruptcy judge on Wednesday refused to delay a decision on chemical firm Chemtura Corp.'s request to ditch reimbursement claims for pollution cleanup costs and product liability damages associated with flavoring agent diacetyl.

Judge Robert Gerber denied creditors’ requests during a hearing in the U.S. Bankruptcy Court for the Southern District of New York to put off rulings on whether Chemtura can disallow the so-called indemnity and contribution claims under Section 502(e)(1)(B) of the Bankruptcy Code.
