Food Lion's Claims Pared In Milk Antitrust MDL Case

Law360, New York (August 5, 2010, 6:28 PM EDT) -- The judge overseeing multidistrict litigation over an alleged antitrust conspiracy in the U.S. milk industry has thrown out three of the five counts in a putative class action brought by Food Lion LLC, but let claims against Dean Foods Co., Dairy Farmers of America Inc. and National Dairy Holdings LP go forward.

Judge J. Ronnie Greer of the U.S. District Court for the Eastern District of Tennessee partially granted the defendants' September 2009 bid for summary judgment Wednesday.
