Select Comfort Class Action Put To Bed

Law360, New York (August 9, 2010, 4:19 PM EDT) -- A federal judge has tossed a proposed class action that accused Select Comfort Corp. of breaching contracts, unjustly enriching itself and violating consumer protection laws by selling beds as new when, in fact, they were refurbished.

Judge John E. Jones III of the U.S. District Court for the Middle District of Pennsylvania found Friday that there was no indication Select Comfort misled the lead plaintiff, John E. Boland, who ordered one of the company's Sleep Number beds in May 2009 for $1,853.
