Ranbaxy Faces False Marking Suit Over Exelderm

Law360, New York (August 10, 2010, 1:40 PM EDT) -- Promote Innovation LLC has accused Ranbaxy Laboratories Inc. of injuring the U.S. government and stifling industry innovation by marking a line of anti-fungus products with a patent that expired in 1996.

Ranbaxy misled the public into believing the company had control over the formula for Exelderm, a cream used to treat skin infections like athlete's foot and ringworm, according to an amended complaint lodged Monday in the U.S. District Court for the Eastern District of Texas.
