3rd Circ. Revives Blueberry Farmers' Suit V. Novartis

Law360, New York (August 10, 2010, 7:03 PM EDT) -- A federal appeals court on Tuesday revived for the second time a suit brought by a group of New Jersey blueberry farmers who allege that their crops were damaged by a pesticide manufactured and distributed by Novartis Crop Protection Inc.

In an opinion penned by Judge Walter K. Stapleton, the U.S. Court of Appeals for the Third Circuit largely overturned a district court's grant of summary judgment to Novartis and remanded the case for further proceedings on most of the plaintiffs' claims.
