Judge Doubles Award In Aero Patent Suit

Law360, New York (July 29, 2004, 12:00 AM EDT) -- A judge has doubled the patent damages and awarded attorney’s fees to mattress maker Aero after finding that two rivals infringed one of its patents.

The patent damages award was increased to $5.9 million, according to William H. Frankel, lead counsel for Aero and a litigator at the intellectual property firm Brinks Hofer Gilson & Lione in Chicago.

The jury had originally awarded Aero damages of $2.95 million for patent infringement and $1 million for trademark infringement.
