Court Refuses To Dismiss AmEx Appeal

Law360 (February 15, 2007, 12:00 AM EST) -- Plaintiffs in a class action antitrust suit against American Express Co. have failed to persuade an appeals court that it lacks jurisdiction due to federal arbitration laws.

Amid a drawn-out battle between plaintiffs and American Express over whether the antitrust suit belongs in court or arbitration, the U.S. Court of Appeals for the Second Circuit ruled Tuesday that for the meantime it has rightful jurisdiction under the Federal Arbitration Act to preside over the matter.
