Bayer Faces False Marking Suit Over Glucose Monitors

Law360, New York (August 13, 2010, 2:56 PM EDT) -- Bayer HealthCare LLC has been slapped with a suit accusing it of marking its Contour and Didget glucose monitoring products with expired patents.

Texas Data Co. LLC attorneys Scott Stevens and Kyle J. Nelson of Stevens Love lodged the complaint in the U.S. District Court for the Eastern District of Texas on Thursday, claiming that Bayer has marked the products with at least two patents it knew were expired, to the detriment of consumers, potential competitors and the United States.
