Logging Runoff Not Exempt From Permits: 9th Circ.

Law360, New York (August 18, 2010, 4:59 PM EDT) -- A federal appeals court has found that runoff from logging roads in Oregon's Tillamook State Forest is subject to permitting requirements under the Clean Water Act, ruling against regulators and timber companies who argued it was exempt.

Overturning a lower court ruling, the U.S. Court of Appeals for the Ninth Circuit said Tuesday that the runoff qualifies as a point source discharge and therefore needs a permit under the National Pollutant Discharge Elimination System.
