8th Circ. Nixes Hospital Antitrust Suit Against CR Bard

Law360, New York (August 18, 2010, 5:26 PM EDT) -- A federal appeals court has affirmed the dismissal of an antitrust class action brought against medical technology manufacturer C.R. Bard Inc. by a hospital, agreeing that St. Francis Medical Center of Cape Girardeau, Mo., has failed to show any antitrust injury.

The U.S. Court of Appeals for the Eighth Circuit said Tuesday the contracts used by Bard to sell catheters did not prevent hospitals from walking away if they found a better deal elsewhere, affirming the lower court's ruling.
