Puerto Rico Developer Wins New Trial In CWA Case

Law360, New York (August 23, 2010, 5:59 PM EDT) -- A federal appeals court has ordered a new trial in a criminal Clean Water Act case against a real estate developer in Puerto Rico, saying a lower court erred in closing the courtroom to the public during jury selection.

The U.S. Court of Appeals for the First Circuit said the judge was wrong to exclude family members of developer Braulio Agosto-Vega from the courtroom because of overcrowding and reversed the convictions of Agosto-Vega and his company, Braulio Agosto Motors Inc., for criminally violating the CWA....
