Wockhardt Exits Sepracor's Lunesta Patent Suit

Law360, New York (August 20, 2010, 4:46 PM EDT) -- Sepracor Inc. has dropped Wockhardt Ltd. from a patent suit accusing various generics makers of infringing patents for sleep drug Lunesta following the reaching of a consent agreement.

The settlement, approved Thursday in the U.S. District Court for the District of New Jersey, enjoins Wockhardt from manufacturing generic Lunesta until one of the patents-in-suit expires in November 2013 or May 2014, depending on potential extensions. That date could move forward if the parties reach a licensing agreement, according to the stipulation.
