9th Circ. Affirms Threatened Status Of Calif. Steelhead

Law360, New York (August 23, 2010, 2:21 PM EDT) -- A federal appeals court has upheld Endangered Species Act protections for steelhead trout in California’s Central Valley, rejecting a challenge from a coalition of irrigation districts.

The National Marine Fisheries Service may list steelhead — a form of the rainbow trout that spends part of its life in fresh water and part in the Pacific Ocean — as threatened under the ESA without including nonmigratory, freshwater rainbow trout in that protected population, a three-judge panel of the U.S. Court of Appeals for the Ninth Circuit ruled...
