Albuquerque Call Center Workers Lose Class Bid

Law360, New York (August 23, 2010, 2:36 PM EDT) -- A federal judge has refused to certify a class action brought by employees of the city of Albuquerque's citizen contact center, saying current workers don't share the interests of terminated employees who allege they were wrongly fired without cause.

Judge James O. Browning of the U.S. District Court for the District of New Mexico said in an order filed Saturday that the conflict of interests of the class defeats the typicality and adequacy requirements for certification.
